Premier Sports – Terms & Conditions

1. General

1.1 General information about Premier Sports

Premier Sports is a personalised Internet-based streaming service that offers access to audiovisual content through subscription, individual purchases, or rental (“Premier Sports”). One of our obligations under these Terms and thus one of the core features embedded within the service is the way Premier Sports is tailored, personalised, and presented to you based on your viewing preferences.

Premier Sports is available through certain internet-connected Smart TVs, mobile phones, and other devices that support our applications (collectively referred to as the “App”) as well as through our web-based app at premiersports.com/gb (the “Website”). Devices that enable access to Premier Sports are listed at premiersports.com/devices.

Premier Sports is provided by Premier Media Broadcasting Limited, incorporated in the Republic of Ireland, registered office at Broadcasting House, 3a Prince’s Street South, Dublin 2, D02 A520, Republic of Ireland, with company number 620991 and VAT number 3529343KH (referred to herein as “the Company,” “we,” “us,” or “our”).

1.2 These Terms & Conditions

These Terms & Conditions (the “Terms”) constitute an agreement between you, the Premier Sports account holder and person responsible for paying our fees (“you” or “your”) and the Company. These Terms govern your use of Premier Sports and apply in whole or in part for as long as you have a Premier Sports user account.

The Additional Terms for Subscribers on the Sky Digital Satellite Platform form part of these Terms only for customers who have purchased a subscription that includes our linear channels on that platform. You are also responsible for ensuring that any users who access and use the Website and/or the App via your Premier Sports user account comply with these Terms where applicable to them. By accepting these Terms, you confirm that you agree to these Terms and will procure the compliance of any users of your Premier Sports account where relevant.

Premier Sports may be offered by third parties, e.g. in conjunction with the provision of their own products and services. These third parties may have additional separate terms and conditions that you must accept in order to access Premier Sports through such third party. We only use your personal information in accordance with our privacy notice, available at premiersports.com/gb/content/privacy.


2. Access to Premier Sports and our content

2.1 Requirements for creating a Premier Sports user account

To create an account and access Premier Sports, you must:

  • have reached the age of 18;
  • provide us with a valid e-mail address (the e-mail address will be your login username);
  • be a permanent resident in the UK (your location may be verified at the time of registration);
  • be a natural person (i.e. not a company or other business entity);
  • register your payment details; and
  • accept and agree to be bound by these Terms.

You agree that any user information provided by you to us is true and correct and that you will update your user information as necessary so that it remains accurate at all times.

2.2 Username and Password

You are responsible for all activity that occurs on your Premier Sports account. Your account is personal and should not be shared with anyone outside your household. Any person outside of your household who uses the account will be considered an unauthorised user.
If you suspect that an unauthorised user has access to, or is using, your account, you must immediately notify us, change your password, and log out of all registered devices. If we have reason to believe your account has been misused, we may suspend your access to Premier Sports immediately.

2.3 Subscription plans and One-Time Purchases

The fees payable for a Premier Sports subscription are referred to as the “Subscription Fee.” Each period that you subscribe to Premier Sports by paying the Subscription Fee is a “Subscription Period.” Your Subscription Period will automatically renew unless you cancel at least thirty (30) days prior to your next billing date.

When you have a user account, you may access the content on Premier Sports via:

  1. Monthly Subscriptions:
    Paying the monthly Subscription Fee in advance to access one of our packages.
  2. Fixed-Term Subscription:
    Subscribing to a package for a predetermined term (e.g., 6 or 12 months). This represents a minimum period during which you are bound to your subscription. Upon expiry of each fixed term, your subscription will automatically renew for another fixed term unless you cancel before the expiry date.
  3. One-Time Payments:
    Paying separately for specific content (such as a one-off purchase, a 48-hour rental, or a live event). If you purchase a piece of content (e.g., a movie), you will have continued access to it for as long as we hold the distribution rights from our licensors. If we can no longer provide access due to expiry of such rights, you may be entitled to a proportionate compensation or refund.

2.4 Technical requirements and Updates

To access Premier Sports, you must have an internet-connected device compatible with our technical requirements. A list of compatible devices and platforms is available on the Website. Meeting these requirements does not guarantee error-free access at all times, as viewing quality may vary depending on factors like location, internet connection, and bandwidth.
We reserve the right to modify system requirements, compatible devices, and platforms (e.g., for security reasons), which may result in certain hardware or software no longer being compatible with Premier Sports.

We have a legal obligation to ensure Premier Sports conforms to these Terms. Accordingly, we may update the App or the Website for security or technical reasons. It is your responsibility to install such updates promptly, including any updates to your device’s operating system, if required. We cannot guarantee that each updated version of the App will function on every device.

2.5 Limitations on concurrent streams, registered devices, and Offline Mode

Your Premier Sports account will only allow one (1) active login at a time. Logging in on a second device will automatically log out the other device.

2.6 Unlawful use of Premier Sports

All content forming part of Premier Sports (including videos, logos, artwork, and underlying software) is protected by UK and international copyright law. Premier Sports reserves the right to monitor access patterns, device usage, and login activity to detect and prevent unauthorized use of the service. You must not, and must not enable others to:

·       Copy, record, store, capture, re-host, or redistribute any content from Premier Sports except as permitted by the Copyright, Designs and Patents Act 1988 (“the Act”), which provides limited exceptions (e.g. fair dealing) that must not conflict with our normal exploitation of the content or unreasonably prejudice our legitimate interests.

·       Show or exhibit any part of Premier Sports in public (such as in bars, clubs, offices, restaurants, or other commercial premises), even if no entrance fee is charged, or otherwise use Premier Sports in a way that directly or indirectly generates commercial gain.

·       Bypass or circumvent any security measures implemented to protect Premier Sports, including reverse engineering, decompiling, modifying, or otherwise tampering with the underlying software, the Website, or the App, or any associated hardware.

Any violation of the above is a material breach of these Terms and may result in immediate suspension or termination of your access. We also reserve the right to take legal action if necessary. Further, we may collaborate with our licensors or other rightsholders, who may also enforce their rights directly against you to the extent permitted by law.


3. Payment, fees, and trial offers

3.1 Billing

To watch content on Premier Sports, you must provide a valid payment method. Unless you cancel your subscription before the next billing date (with at least thirty (30) days’ notice), we will charge the Subscription Fee for the next Subscription Period. If payment fails, we may continue to try to collect payment and suspend or terminate your access until successful.

If you signed up via a third party and are billed by them, their payment terms will apply. Update your payment details directly with the third party as needed.

3.2 Fees and changes to your subscription plan

Subscription Fees and other charges are outlined on the Website. One-Time Payments are charged separately from the Subscription Fee. The prices shown do not include any data charges that your internet or telecom provider may impose, nor do they include any transaction fees your bank or credit card provider may charge.

We may change our Subscription Fees and other charges (“Fee Change”) from time to time. We will notify you via email and/or your Premier Sports account with at least thirty (30) days’ notice before the Fee Change becomes effective, except where a shorter notice is permitted by law (e.g., if our costs suddenly increase due to a change in tax or a decision by an authority). If you do not accept a Fee Change, you may cancel your subscription without penalty, effective from the date the Fee Change would otherwise apply. If you are on a Fixed-Term Subscription paid in monthly instalments and you cancel in accordance with this paragraph, we will refund you any prorated amounts.

3.3 Discounted Offers

We may offer discounted subscriptions to new customers for a limited time (“Discounted Offer”). Such offers typically convert to a standard monthly subscription upon expiry unless you cancel with thirty (30) days’ notice. If you or someone in your household has previously used a similar discounted or promotional offer, standard pricing may apply instead.


4. Errors in the service

If you experience errors with Premier Sports not caused by you or an unauthorised user, you may be entitled to remedies under consumer protection laws. If the error is potentially caused by your device, software, or network, you must cooperate with us to help identify the source of the error.

Premier Sports availability may be impacted by events or issues beyond our control, such as internet outages or ISP problems, for which we are not responsible.


5. Right of withdrawal

If you sign up for a Premier Sports subscription, you have a statutory right to withdraw within fourteen (14) days of your initial subscription. If you start using the Service during this period, we may deduct an amount proportional to your usage from any refund.
If you purchase content via a One-Time Payment, you can withdraw within fourteen (14) days unless you start streaming the purchased content during that period, in which case you lose the right to withdraw.
To exercise this right, contact our Customer Service (details in Section 11).


6. Termination

6.1 Your termination

You may terminate your subscription at any time via the “My Account” page on the Website. Your termination will take effect:

  • At the end of the Subscription Period in which you cancel (for Fixed-Term Subscriptions, at the end of the fixed term); or
  • At the end of the relevant notice period required in the “Changes in Premier Sports and to these terms” or “Fees and changes to your subscription plan” sections, provided you give at least thirty (30) days’ notice.

Unless otherwise required by law or these Terms, you are not entitled to a refund for any remainder of a current Subscription Period that you do not use. You will retain access to any content purchased via One-Time Payment, unless we are required (by law or licensor terms) to remove that content.

If you have purchased access through a third party, you must terminate your subscription with them directly in accordance with their terms.

6.2 Our termination

We reserve the right to terminate your subscription or suspend your access to Premier Sports at any time.

  • If we terminate your subscription, we will offer either continued access for the remainder of the current Subscription Period or a proportional refund, and/or continued access to One-Time Payment content, if we have rights to do so.
  • We may suspend or terminate your access immediately and require payment of any outstanding Subscription Fee(s) if you breach these Terms. If you have a Fixed-Term Subscription, we may require immediate payment of the entire remaining Subscription Fee for the term.

7. Amazon Giftcard Prize Draw Terms & Conditions

  1. Eligibility: Participants must complete the customer survey and submit their email.
  2. Entry Limit: Only one entry per email address.
  3. Prize: One winner will be selected randomly to receive a £150 Amazon voucher.
  4. Winner Selection: The winner will be notified via the email provided. If the winner does not respond within 7 days, a new winner may be selected.
  5. Non-Transferable: The prize cannot be exchanged for cash.
  6. Organizer’s Rights: We reserve the right to amend or cancel the draw at any time.

8. Changes in Premier Sports and to these terms

We constantly work to improve Premier Sports, so the quantity, quality, or features of available content may change. We may update or amend these Terms for various reasons, such as technical, operational, or legal requirements. If we make a change that negatively affects your use of Premier Sports or constitutes a Fee Change, we will notify you at least thirty (30) days in advance by email.
You may terminate your subscription without penalty if a change has a non-negligible negative effect on you, provided you inform us no later than the day before the change takes effect. If you are on a Fixed-Term Subscription and cancel for this reason, we will refund any unused portion of your Subscription Fee on a prorated basis.


9. Additional legal terms

9.1 Liability

  1. Non-excludable Liability
    We do not exclude or limit our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and supplying digital content that is not of satisfactory quality or fit for purpose, or failing to use reasonable care and skill under the Consumer Rights Act 2015.
  2. Service Interruptions and Force Majeure
    We are not liable for any failure or delay in performing our obligations under these Terms if caused by events outside our reasonable control, such as network failures, power outages, or restrictions imposed by governmental authorities.
  3. Foreseeable Loss or Damage
    If we fail to comply with these Terms, we are responsible for any loss or damage you suffer that is a foreseeable result of our breach or negligence, but not for loss or damage that is not foreseeable or for business losses (e.g., loss of profits).
  4. Website Links
    Our Website may link to third-party sites over which we have no control, and we accept no liability for any content on those sites.

9.2 Indemnification

You agree to indemnify and hold us (and our affiliates, partners, or licensors) harmless from all losses, damages, and costs (including reasonable legal fees) arising out of any breach by you of these Terms or applicable law.

9.3 Invalidity of Provisions

If any provision of these Terms is deemed invalid or unenforceable, it shall not affect the validity of the remaining provisions.

9.4 Transfer

These Terms apply to you as a user of Premier Sports, and you may not transfer your rights or obligations under these Terms. We may transfer our rights and obligations under these Terms to a third party or to another company within our corporate group. If such a transfer materially affects your rights, you may terminate your subscription without penalty by notifying us before the effective date of the transfer.

9.5 Dispute resolution and Applicable Law

These Terms are governed by the laws of England and Wales. You can bring legal proceedings in respect of these Terms in the courts of England and Wales (or, if you live in Scotland or Northern Ireland, in certain courts there, as permitted by law). If Premier Sports is directed to the country where you reside, you will also benefit from any mandatory provisions of local law that may apply.

9.6 Force Majeure

We are not liable to you if our performance under these Terms is restricted or prevented due to reasons beyond our reasonable control (e.g., official decisions, changes in law, natural disasters, or network failures).

11. Sky Digital Satellite Platform

Premier Sports 1 & Premier Sports 2 are under the supervision of the British authority Ofcom, which regulates editorial content for programming services in the UK. If you have submitted a complaint to us regarding content transmitted via these channels and are dissatisfied with our response, you may forward your complaint to Ofcom using their form at:

12. Additional terms for subscribers on the Sky Digital Satellite Platform

12.1 Definitions

  • Address: Your home address in the United Kingdom.
  • Channels: Premier Sports 1 and Premier Sports 2.
  • Digibox: An authorised satellite decoder that uses Sky’s encryption system.
  • Multibox(es): Additional set top boxes at your registered Address (up to four).
  • Sky: Sky UK Limited.
  • SSSL: Sky Subscribers Services Limited.
  • Viewing Card: A card allowing decryption of digital satellite services (such as the Channels) when used with a Digibox.

12.2 Your Viewing Card

The Viewing Card remains the property of SSSL. Only you may use the Viewing Card at your Address with the Digibox in which it was first used. You must not use it for commercial or business purposes (e.g., pubs, hotels) nor for any location outside the UK.
You must not tamper with the Viewing Card or Digibox. You must keep the Digibox connected to a mains supply, suitable satellite dish, and in standby mode when not in use. Sky and/or SSSL may update your Digibox software remotely. If you misuse the Viewing Card, we may cancel it without notice or refund.

12.3 Channels and Programming

We may replace, withdraw, or vary advertised programmes on the Channels, change their hours, or transfer programmes between Channels. If a significant reduction of service occurs, you may have rights to cancel under “Changes in Premier Sports and to these Terms.”

12.4 Copying and copyright

  • You must not do any of the following:
  • Unauthorized Copying, Recording, or Storage
    Copy, record, store, reproduce, transmit, redistribute, stream-capture, or otherwise exploit any part of the Channels in a manner not expressly permitted by these Terms or applicable copyright law. This includes using any device or method (software, hardware, or otherwise) to capture or download the Channels’ audio or video content.
  • Commercial Use and Public Exhibition
    Produce, supply, display, or otherwise exploit any programme, service, or content (whether audio-only, audiovisual, or otherwise) from the Channels for any commercial purpose, or allow any third party to do so. You must not sell or make any charge for viewing the Channels or show the Channels to an audience in public (e.g., in bars, restaurants, hotels, offices, or other commercial premises), even if no entrance fee is charged.
  • Tampering with Security Measures
    Circumvent, alter, disable, decompile, reverse-engineer, or otherwise interfere with any security measures, encryption, watermarking, rights management, or other technology protecting the Channels or Digibox. You must not modify, remove, or obscure any graphics, logos, or on-screen text appearing on the Channels.
  • Sharing or Sub-licensing
    Provide or make available your Digibox, Viewing Card, or any Channels content to any unauthorized third party in a way that breaches these Terms. This includes any attempt to sub-license, resell, or grant access to content or functions of the Channels for financial gain or public exhibition.

We reserve the right (and our content partners also reserve the right) to pursue any remedy available under applicable law for breach of this section, which may include immediate suspension or termination of your subscription and/or legal action for damages. We or our content partners may enforce intellectual property rights or other contractual rights directly against you to the fullest extent permitted by law.

We may also remotely disable or alter certain functions of your Digibox to prevent copying or unauthorized access to the Channels, and we may restrict or cancel your access if your Digibox is configured to allow copying or redistribution of content that we are obligated by contract to protect.

 

12.5 Miscellaneous

In addition to the termination rights in Section 6, we may end your subscription for any Channel at any time if we cease to broadcast that Channel for any reason.
